Types of Child Custody
There are two different types of child custody under Utah law, which can be divided in different ways. Legal custody involves the legal right to make decisions about a child's life, such as education and medical care, while physical custody has to do with time spent with children and where the children live. A court may order different types of custody arrangements such as:
- Sole legal and sole physical: Either party can be awarded the "sole" custody of the children, meaning one parent has physical custody of the children and makes the major decisions about the children's lives.
- Joint legal and joint physical: This arrangement is one in which both parents make important decisions concerning their children. Joint custody is most successful when both parents communicate well with one another and are willing to work together to take care of the children's needs.
- Joint legal and sole physical: In this arrangement, children live with one parent over 254 nights per year. However, both parents are involved in making decisions affecting the child.
